1. For this Clipping, view the short video and think about the constitutional issue of States’ Rights. In 1925 under Gitlow v. New York, the USSC held that the Bill of Rights applied to the states as well as to the federal government in terms of the 14th Amendment. After WWII, we begin to see waves of discriminatory acts using “States’ Rights” as the legal justification until 1952 in the landmark decision Brown v. Board of Education . The Brown decision found that racially “separate but equal” policies unconstitutionally denied Black children the same educational opportunities as White children. This led to a national consciousness of anti-desegregation laws both federally and statewide. Modernly, States’ rights continues to permeate the national fabric.
